Unions, NLRB Still Holding ASARCO Accountable

The unions representing workers at the five ASARCO properties in the U.S. are continuing to hold the company accountable for its violations of federal labor laws.

Since August 2022, the NLRB has been prosecuting its case against ASARCO before an administrative law judge.

Recently, witnesses for the unions concluded their testimony against the company, and the next step will be management’s defense.

In the meantime, the unions are pursuing separate unfair labor practice charges over ASARCO’s unlawful withdrawal of recognition at Mission and Silver Bell.

While we had hoped to have the charges prosecuted during the current trial, the NLRB has decided to investigate and hear them separately. The NLRB has issued a complaint on those charges, though, and we are now waiting for the next trial to be scheduled. Although the wheels of justice turn slowly, we must continue to be patient and diligent while the process continues.

ASARCO and its corporate parent, Grupo Mexico, have established a track record of flouting labor, environmental and other laws in countries where they operate, and we remain committed to working with the international labor community and other allies to fight against this greed and exploitation.
